Terms of use

These terms are the rules for using tracker by aquarela, offered by Aquarela Serviços e Tecnologia Ltda. ("Aquarela"), CNPJ (Brazilian company registry) 36.683.319/0001-06. By using the tracker, you agree to them. If your company has a signed contract with Aquarela, the contract prevails over these terms wherever they differ.

The service

The tracker is a project management tool for teams: tasks, board, backlog, sprints, releases, tests, hours, documents, customer service, status pages, ideas board, reports and an AI assistant. It works in the browser, in the mobile and desktop apps and in connected AI assistants such as ChatGPT, Claude and Codex.

Accounts and access

• Sign-in uses your aquarela ID account. You are responsible for keeping your account secure and for what is done with it.
• Companies are created by Aquarela. Whoever administers a company in the tracker invites people, changes their roles and removes them.
• Use truthful information and let support know if you suspect improper use of your account.

Acceptable use

You may not:

• put in the tracker content that is illegal, that violates other people's rights or that contains malicious code;
• try to access another company's data or circumvent permissions, limits and security measures;
• overload the service or use bots outside the API, the MCP and the limits offered;
• use customer service, emails or webhooks to send spam;
• copy, resell or reverse engineer the tracker, except as permitted by law.

Your content

The content your company puts in the tracker remains its own. Aquarela uses this content only to provide the service, as described in the privacy policy. The company is responsible for having the right to use what it puts in the tracker, including personal data of the customers served through the portal, and for what it decides to publish on public pages.

AI features

The AI assistant can make mistakes. Review what it writes or suggests before using it, especially in important decisions. AI usage may have monthly limits per company.

Third-party integrations and assistants

Slack, GitHub, Sentry, ChatGPT, Claude, Codex and other connected services follow the terms of whoever offers them. Aquarela is not responsible for these services. You can revoke a connection at any time in Your account → Connections, and whoever administers the company can turn off its integrations.

API, MCP and tokens

Personal tokens and connections act on your behalf, with your permissions. Do not share a token. We may limit the volume of calls and change the API, giving advance notice of changes that break integrations.

Price and payment

The price and the payment method are in the commercial proposal or in your company's contract with Aquarela.

Availability and changes

We work to keep the tracker up all the time, but it may stop for maintenance or because of failures beyond our control. Availability guarantees, if any, are in the contract. We may improve, change or remove features; if a change affects your company's use in a relevant way, we let you know beforehand.

Intellectual property

The tracker, the brand, the software and the documentation belong to Aquarela. These terms do not transfer any of these rights; they only allow use of the service.

Suspension and termination

We may suspend an account or company that violates these terms or puts the service or other people at risk, giving notice when possible. The company may stop using the service according to its contract and export its data before the end. What happens to the data afterwards is in the privacy policy.

Liability

To the extent permitted by law, Aquarela is not liable for indirect damages, lost profits or data loss caused by improper use, and Aquarela's total liability is limited to the amount paid by the company in the 12 months before the event. Nothing here excludes rights that the law does not allow to be limited.

Changes to these terms

When these terms change, we update the date at the top of the page. If the change is relevant, we let you know by email or in the app before it takes effect.

Governing law and jurisdiction

These terms are governed by the laws of Brazil. The courts of the district of Aquarela's headquarters are chosen to resolve any matter concerning them.
